Legal Updates for AMWU Members in Western Australia
 
Pluto
 
The AMWU has filed a motion with the Federal Court in relation to the service process.  We argued that a number of respondents had not been properly served under the rules and hence the Court did not have any jurisdiction to make appearances conditional.  This motion was dismissed on 27 July 2010.
 
The Court has ordered mediation to occur and it is our intention to reach a settlement of some form will be reached with employers and ABCC.  The AMWU has contacted all members who where listed as respondents. We sent correspondence to the addresses in our database seeking authority for Gibson and Gibson to act on their behalf.  We also advised that we would only represent members who were financial.  A reminder was again sent to members stating that we needed to have their authorities to file appearances on their behalf, and to ensure they were financial.  Our Organisers in Karratha were also informing members that if they were involved in Pluto they had to make sure they signed the authorities for Gibson and Gibson.

Mediation with the ABCC is scheduled for 21 September and Steve McCartney will be attending on our members behalf.
 
We remind all members that in order to be represented they must stay financial.
